Quality Analyzer — Audio Analysis for iOS and macOS

1. Scope, Acceptance & Apple Standard EULA

Quality Analyzer (the "App") is distributed through Apple’s App Store and is licensed, not sold. Apple’s Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary licence agreement for the App. These Supplemental Terms describe App-specific functionality, privacy practices, measurement limitations, and responsibilities and supplement, rather than replace, the Apple Standard EULA.

By downloading, installing, purchasing, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory rights granted by applicable law always prevail over any conflicting provision.

2. Developer & Contact Identity

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). Public seller and trader information applicable to your territory is also displayed by Apple on the App Store product page.

3. App Functionality & Platform

Quality Analyzer provides audio-file analysis on iOS and macOS, including spectral and perceptual information, spectrograms, and playback-system compatibility indicators. On iOS, Live Mode can use the microphone to display real-time A-weighted sound-level and spectrum estimates.

Available functions, supported formats, device compatibility, and minimum operating-system requirements are those shown in the current App Store listing and installed App. Results vary with the source audio, microphone, device model, microphone orientation, case, environment, calibration, operating-system processing, and hardware condition.

4. Licence & Permitted Use

Subject to the Apple Standard EULA and these Supplemental Terms, the included licence permits personal and professional use of the App. No use makes the App or its measurements certified, calibrated, or suitable for regulated decisions.

Except where applicable law expressly permits otherwise, you may not copy, redistribute, rent, sublicense, reverse-engineer, decompile, disassemble, bypass protection, extract proprietary assets, or use the App or its components to create a competing product.

5. App Store Distribution, Payments & Refunds

Apple handles App distribution and, where applicable, price, taxes, payment details, purchase entitlements, Family Sharing or other Usage Rules, and refund requests. The Developer does not receive your payment-card details. The current App Store listing states whether a price, in-app purchase, subscription, or trial is offered; these Terms do not create or promise any payment option or trial not shown there. Mandatory refund and consumer rights remain unaffected.

6. App Privacy — Local Audio Analysis

The Developer operates no account system or backend server for the App. Audio files you select and analysis results are processed locally and are not uploaded to the Developer. The App contains no Developer-operated advertising, behavioural tracking, analytics, or telemetry.

Files, reports, or screenshots leave the device only when you deliberately save, synchronise, or share them through a location or service you choose. Those services apply their own privacy terms.

7. Microphone Use in iOS Live Mode

If you grant microphone permission and start Live Mode, the App processes microphone input locally to calculate and display live sound-level and spectrum estimates. The App does not record or store that microphone audio and does not transmit it to the Developer or a server. You may revoke microphone access at any time in device Settings; Live Mode will then be unavailable.

8. Apple Services & Diagnostics

Apple may process App Store transactions, installations, crash reports, and optional diagnostics under the user’s Apple privacy and diagnostics settings. Apple may provide developers with aggregated analytics or diagnostic reports. The App does not add its own tracking to that Apple-controlled process.

9. Support & Website Information

Sorin Nae is the data controller for personal information voluntarily submitted through support channels or the Software Evolution website contact form.

If you contact us, we receive the information you choose to provide, such as your name, email address, message, App version, device details, screenshots, or diagnostic files. We use it only to respond, provide support, prevent abuse, comply with legal obligations, or establish and defend legal claims. The legal basis is performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations where applicable.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Those providers may process form and technical connection data under their own policies. Do not send passwords, payment-card details, private recordings, or unnecessary sensitive information through support channels.

Support correspondence is retained only as long as reasonably necessary to answer the request, maintain support and security records, meet legal obligations, or resolve disputes, and is then deleted or anonymised where appropriate.

10. Your Data-Protection Rights

Because App audio and analyses remain on your device, the Developer normally has no server-side copy to access or delete. For personal information voluntarily provided through support, applicable law may give you rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to contact@softwareevolution.ro. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

11. Your Audio & Required Rights

You retain ownership of audio and other content you select. Selecting content authorises the App to process it locally for the analysis you request; it does not transfer ownership to the Developer. You are responsible for having the rights and permissions required to access, analyse, reproduce, export, or share third-party audio.

12. Measurement and Analysis Limitations

References in product descriptions to standards, weighting methods, measurement ranges, professional workflows, or system compatibility describe implemented calculations and intended use; they do not represent certification of the App, the device microphone, or any result. Consumer-device microphones are not interchangeable with calibrated measurement equipment.

• Do not use Live Mode to set safe exposure time, select hearing protection, or decide whether a sound environment is safe.
• Do not use results for workplace, venue, environmental, building, product, broadcast, or legal compliance.
• Do not use results for medical, diagnostic, treatment, emergency, or public-safety decisions.
• For any regulated or safety-critical purpose, use properly calibrated, certified equipment and a qualified professional.

Compatibility scores, warmth, clarity, dynamics, spaciousness, spectral information, and other analysis outputs are estimates rather than guarantees of playback quality, mastering quality, audience perception, or performance on a particular sound system.

13. Files, Reports & Backups

Keep independent copies of source audio and review any saved analysis or exported material before relying on it. The App is an analysis aid, not a backup, archival, mastering, compliance, or monitoring service.

14. Intellectual Property & Trademarks

The App, source code, interface, documentation, analysis methods, and proprietary assets are protected by intellectual-property law and are owned by or licensed to the Developer, except for clearly identified third-party components and rights. Apple and other third-party names and trademarks remain the property of their respective owners and are used only for identification. No affiliation or endorsement is implied.

15. Warranties & Mandatory Consumer Rights

The Apple Standard EULA contains the warranty terms applicable to the App. To the maximum extent permitted by law, the App is provided "as is" and "as available", and the Developer does not promise error-free operation, measurement accuracy, certification, or compatibility with every file, device, microphone, sound system, or future operating system.

16. Limitation of Liability

Nothing in these Terms excludes liability for fraud, intentional misconduct, or any injury, damage, remedy, or responsibility that applicable law does not allow to be excluded or limited.

Subject to that rule and to the maximum extent permitted by law, the Developer is not liable for indirect or consequential loss or for decisions made contrary to the measurement warnings above. Nothing here reduces a protection provided by the Apple Standard EULA or mandatory consumer law.

17. Updates, Availability & Termination

Features, supported formats, minimum system versions, and interface details may change as the App evolves. Required updates will be provided as required by applicable law. Your licence may terminate if you materially breach the Apple Standard EULA or these Supplemental Terms, subject to applicable law. Termination does not transfer ownership of your audio or local results to the Developer.

18. Changes, Governing Law & Disputes

We may update these Terms to reflect functionality, legal requirements, security needs, or business changes. Material changes will be communicated by reasonable means and will not retroactively remove a purchased entitlement or mandatory consumer right. Where consent is legally required, a change takes effect only after valid consent.

These Supplemental Terms are governed by Romanian law, without depriving consumers of mandatory protections or courts available under the law of their country of habitual residence. Please contact us first so we can attempt to resolve a concern.
